EGLO India Private Limited, having its registered office at A-307, Ansal Chambers - I, 3 Bhikaji Cama Place, New Delhi 110066, India (hereinafter, “EGLO India” or “we”, “our” or “us”), provides the below Trademark & Copyright Policy (“Policy”) in respect of the Product(s). 

For the purpose of this Policy, “user”, “you”, “your” shall mean the original and immediate purchaser of the Product(s), and/or the invoice against the purchase of the Product(s) from EGLO India.  All capitalized terms used and not defined herein shall have the meaning set forth in the General Terms & Conditions.

This Policy, together with the General Terms and Conditions of EGLO India, constitutes the entire agreement between you and EGLO India with respect to your use of the Product(s) and its Intellectual Property (defined below).

1. APPLICABILITY OF THE POLICY

This  Policy  governs the terms and conditions for the utilization of trademarks, service marks, logos, trade names, and copyrighted materials (hereinafter collectively referred to as "Intellectual Property") owned by EGLO India or its subsidiaries, or licensors. By purchasing Products from EGLO India, you acknowledge and agree to abide by the terms and conditions set forth in this Policy.

2. PROPRIETARY RIGHTS OF EGLO INDIA

All Intellectual Property displayed by EGLO  India, including, but not limited to, text, graphics, logos, designs, photographs, and images, constitutes the exclusive property of EGLO India or its licensors and is protected under the applicable trademark, copyright, and other intellectual property laws. Except as explicitly authorized in writing by EGLO India, you are prohibited from using, reproducing, distributing, displaying, or creating derivative works from any Intellectual Property displayed by EGLO India.

3. LIMITED LICENSE GRANT 

EGLO India hereby grants you a limited, non-exclusive, non-transferable, and revocable license to use the Intellectual Property associated with the purchased Products solely for your personal, non-commercial purposes, subject to your compliance with this Policy and the General Terms and Conditions of EGLO India. This license does not encompass any resale or commercial utilization of the Products or their associated Intellectual Property, or any derivative use thereof. Any unauthorized use of the Products or their associated Intellectual Property immediately and automatically terminates the license granted to you by EGLO India.

4. PROHIBITED CONDUCT 

You are expressly forbidden from using the Intellectual Property in any capacity that:

1. infringes upon, misappropriates, or otherwise violates the trademark, copyright, or other intellectual property rights of EGLO India or any third party;
2. is liable to generate confusion, mistake, or deception regarding the source, origin, sponsorship, or endorsement of the Product offered by EGLO India  ;
3. dilutes, tarnishes, or otherwise adversely impacts the reputation or goodwill associated with EGLO India or its Intellectual Property;
4. seeks to circumvent any technological measures implemented to safeguard the Intellectual Property or Product; or
5. is otherwise prohibited by the applicable law.

5. NOTICE OF INFRINGEMENT

If you have reason to believe that any content displayed on or made available by EGLO India infringes upon your copyright or trademark rights, or otherwise violates your intellectual property rights, you are requested to notify EGLO India at the address provided below by providing the following information:

1. physical or electronic signature of the individual authorized to act on behalf of the owner of the intellectual property right purportedly infringed or violated;
2. description of the copyrighted work, trademark, or other intellectual property right that you allege has been infringed or violated;
3. description of the location of the material that you claim infringes or violates your intellectual property rights, specifying the exact URL;
4. your contact details, including your address, telephone number, and email address;
5. declaration by you that you possess a good faith belief that the disputed use is unauthorized by the intellectual property owner, its agent, or the law; and
6. statement by you, made under penalty of perjury, attesting to the accuracy of the information contained in your notice and your status as the intellectual property owner or the authorized representative thereof.

6. ENFORCEMENT MEASURES AND RECOURSE

EGLO India reserves the right, exercisable at its sole discretion, to adopt any measures it deems necessary to enforce this Policy and protect its Intellectual Property. Such measures may include, but are not limited to, terminating your access to the Store, seeking injunctive relief, and pursuing any other available legal or equitable remedies.

7. AMENDMENT

EGLO India retains the right to modify this Policy at any time and without prior notice. Your continued purchase of Products from EGLO India following the implementation of any such modifications constitutes your acceptance of the amended or revised Policy.
